TERMS AND CONDITIONS for Purchase of food from Snob Cloud LLC.
Our Guarantee
Snob Cloud LLC will provide to a Customer a professionally decorated dessert in a timely manner as specified in the invoice or contract. We appreciate your business and we are honored that you have chosen us for your special celebration. We guarantee that the flavors, size, and general design elements will be met as outlined.
INGREDIENTS
All cakes, fillings and icings may contain, or come into contact with, soy, wheat, dairy, nuts or other allergens. SNOB CLOUD PRODUCTS ARE NOT ALLERGEN FREE.
*It is the responsibility of the Customer to inform Snob Cloud LLC prior to the confirmation of their booking of any allergy issues.
*If you having any allergies of food sensitivity, unfortunately our cakes are not for you.
*It is the responsibility of the Customer to inform their guests of all allergy information and accordingly, Snob Cloud LLC will not be held liable for any allergic reaction resulting from consumption of the cake
*All products are made to be eaten on the day of the celebration.
QUOTATIONS
All Quotations are individual and valid for 7 days from the date of issue.
DEPOSITS
A non-refundable deposit of 50% is required to hold your date within seven (7) days prior to pickup. We will not be accepting the order without the deposit.
Order confirmation will be emailed to you. Without the email confirmation you do not have your cake reserved.
(If you have paid the deposit but did not received the email please contact me ASAP via email ).
We accept all Credit, Debit Cards, Cash and Zelle payments.
ORDERS
We prefer at least five (5) days notice for all orders, We will however endeavor, where availability permits to accept short notice cakes.
Any Products ordered from a picture or photo of a product produced by any other cake maker, can only be reproduced by us as our interpretation of that product and will NOT be an exact reproduction of the product in the picture or photo.
UNFORESEEN CIRCUMSTANCES
We reserve the right to cancel the booking under certain circumstances (baker’s illness). In the unlikely event that this happens, the deposit will be fully refunded within five (5) days of notification to the Customer.
However any other unforeseen circumstance that affects the ability to deliver the ordered Product, Snob Cloud LLC will not be liable for any delay due to circumstance beyond our control. This includes inclement weather, acts of God, or other causes that make it impossible for Snob Cloud LLC to complete the order.
FINAL BALANCE PAYMENTS AND PICKUPS
The Final balance is due 1 day before pickup date, and before the Product leaves the premises.
If paying by cash, correct change is appreciated, as we may not have the exact change. We will arrange the money pick up.
If paying by internet transfer, the money needs to hit the account BEFORE the product leaves the premises.
It is the responsibility of the Customer to check the state of the product before leaving the premises. Once the item has left the premises, the Customer is responsible to ensure that products gets to its destination safely and is stored as per our instructions to achieve best results for taste and quality.
DELIVERY
We offer delivery for certain destinations for a fee. Only local delivery is free. ( Fort Mill area). Delivery fee will apply depending on the distance. Delivery will be carried out in a safe and appropriate manner. Once delivered to the customer and change of hands has been completed with the product in appropriate condition, it is then up to the customer to store and care for the cake as per our instructions. If anything is to happen to the cake after this exchange, we are not liable for any damages.
A delivery date, location and time will be agreed by both parties, and if the customer is not at location at this time and date, and we are not able to contact the customer, the product will be transported back with our premises and it will be the customer’s responsibility to collect the product.
PICKUP
The Customer is liable for any damage, accident, or mishap that may occur once the cake is released from the care and custody of the Snob Cloud LLC , we are not liable for any damage that may occur thereafter.
Care and Handling
We are not responsible for any damage to the cake after pick-up or after setup is complete. Once we have delivered and set up the cake at the venue or delivery location and received a signature for the safe receipt of the cake on our delivery note (we will deliver with a delivery note).
The client is responsible for providing an appropriate and secure table and environment for the cake(s). Cakes are heavy and require a sturdy table, and optimal room temperature of 75 degrees or below. Cakes made by Snob Cloud LLC placed outside are liable to react to the temperature. In hot or humid weather there is the possibility of sugar decorations melting or damage to the product. Please note, we do not provide cake tables, tablecloths or cutting knives. It is the responsibility of the Customer to provide these or check with the venue to ensure these items are provided. A shelf life and Best Before Date will be provided on the Delivery Note. This is advisory only. Please note, once cakes have been cut into the shelf life will be reduced.
If you or your representative elects to pick up and set up the cake, you assume all liability and responsibility for the condition of the cake once it leaves the possession of the Snob Cloud LLC.
In the case of fresh flower usage on the cake, the responsibility of the flower safety and safe food practices will rest with the florist and not with Snob Cloud LLC The person placing this order should obtain a notice of plant safety.
SnobCloud is not responsible for any damage to the cake caused by the placement of flowers by another party or other items on the cake.
If the client or client representative is not available to receive the delivery. A re-delivery fee will be required at the time of receipt of goods and services.
NON-EDIBLE INGREDIENTS AND DECORATIONS
Our cakes may contain non-edible ingredients or decorations, such as plastic dowels in tiered cakes or wires in some sugar flowers. These will be detailed on the Delivery Note and must be removed before serving or eating. Snob Cloud LLC is not responsible for supplying fresh flowers or cake toppers that are not included in the design of your cake. You acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants.
COMPLAINTS
If you wish to make a complaint to us or let us know any concerns after receiving the cake , please do so in writing. Evidence of any faults, damages or discrepancies should be included. Any refunds will be given entirely at our discretion.
PRODUCT INFORMATION
The images on the website are examples of our cakes. All our products are hand-made by me and can be ordered in different sizes from those shown on the website. If the cake you order is a different size from the design pictured on our website, the cake may look slightly different due to the different proportions.
PUBLICATION
We reserve the right to use any image of a Product made by us for publication at a later date.
RETURN OF HIRED EQUIPMENT
Deposits are taken for all equipment. All equipment must be returned on agreed date or extra charges may be levied to cover additional costs. Any damages to equipment will incur a reduction of deposit returned in order to cover costs of repair or replacement.
DAMAGE
If a third party will be collecting the cake on the customer’s behalf, a release form is to be signed by that person, stating the cake is received in good condition at the time of pickup/delivery.
REFUNDS /CANCELLATION/ POSTPONEMENT POLICY
If, for any reason the event is required to be postponed, please contact me immediately. The new date proposed will be subject to availability, we will do our best to accommodate you.
CANCELLATIONS/REFUNDS
If cancellation of the order is required, and you have paid your full balance, the refund policy is as follows:
All Cancellations must be in writing via e-mail.
If the cancellation is up to one (1) month in advance of your event date, you will receive a refund, less your initial deposit that is NOT REFUNDABLE and the cost of any supplies already purchased for your cake. Refunds will be paid within 30 days of cancellation.
If the cancellation is less than seven (7) days prior to your event, there will be no refunds given.
In the event that your event is canceled, all deposits and payments for your order are non-refundable and will NOT be issued under any circumstances.
